In Switzerland, there are numerous artists’ foundations whose purpose is to manage their work, as well as, more generally, foundations involved in the cultural field. Some of them hold copyright which may generate important revenues. However, the holding of such rights by a foundation involves challenges and risks. Indeed, not only do these foundations often act as a gatekeeper to the market of the artist concerned, as abuses can be numerous, but they also carry out multiple activities to make his work known and to spread its influence. Insofar as these foundations are tax-exempt, they are nevertheless limited in their ability to engage in profit-making activities. This Philanthropy Lunch aims to examine the practical and legal issues facing copyright foundations.
